1 - Purpose

These Terms & Conditions (together with the Privacy and Cookies Policy) establish the conditions that determine the use of this website and regulate the conditions of the process of purchasing products from it, being accessible at each moment of the website, according to the existing stock.

AMAZE invites you to carefully read the content of the aforementioned agreements before using either our website or the associated face-to-face services.

To place an order on the website, you must be at least 18 (eighteen) years old, or, if you are a minor, have authorisation from your parents or legal representatives to contract under the legal terms. By using this website or making use of AMAZE's services, you declare that you fulfil these conditions.

These Terms & Conditions may be amended at any time, in which case we will publish an updated version on the website. The use of the website and the placing of any order after AMAZE has published the new version of the Terms & Conditions will be subject to the version of the Terms & Conditions in force.

The following Terms & Conditions regulate the sale of the products presented on the website by the entity:

When using the website, you must ensure that the mandatory information provided is correct and complete. We ask that you inform AMAZE of any changes to your identification data, namely postal address, e-mail address and other contact details, by updating your personal details on the website without delay.

The website allows you to make a purchase using the ‘Buy as a Guest’ feature, and you do not need to register to do so. However, you must ensure that the mandatory information provided is correct and complete. Only personal data that is strictly necessary to fulfil your order is requested and will only be used for this purpose.

By using the website, you agree not to place false or fraudulent orders and AMAZE may, if it considers that such an order has been placed, cancel it and inform the competent authorities.

2 - Purchase procedure

Para efetuar a encomenda de um ou mais produtos disponíveis no website, deverá respeitar os seguintes procedimentos:
Escolher o produto no website da AMAZE;

Add the product to the ‘Basket’;

Then click on ‘Buy’;

You can proceed with the Purchase as a Guest (‘Buy as a Guest’)

Then fill in the form with the following information:
– Name and surname;
– Address and district;
– Telephone number;
– Email;
– Billing address;
– VAT

Once you have filled in the form with all the above information, you must select the Delivery Method for the product, in accordance with Point 4 below. Next, you must choose one of the Payment Methods available (see Point 3 below). Finally, click on ‘Confirm Payment’

In order to ‘Confirm Payment’, you must first accept these Terms & Conditions.

Once the order has been finalised, AMAZE will send you an ‘Order Confirmation’ email. This email is merely an automated confirmation that we have received your order and in which you will be sent information on the order number and date, delivery and payment method, delivery and billing address, product price, shipping costs, product identification and its basic characteristics.

Always make sure you review your purchase before clicking on ‘Confirm Payment’. Before clicking on ‘Confirm Payment’, you have the opportunity to edit all the information you have entered, such as the shipping or billing address, the payment information, or to add, change or remove products in the ‘Basket’.

The invoice for your purchase will be sent to the email address associated with your order.

3 - Payments

Payments can be made via Multibanco and Debit/Credit Cards.

All orders are processed in the local currency of the country of purchase. If your bank account is in another currency, the exchange rate used to debit your account will be automatically determined by the bank and not by AMAZE.

4 - Shipping / Delivery

The products presented on the website are only available for delivery nationally (see Section 4.1) and internationally (see Section 4.2). Shipments of more than 2kg per shipment are not possible.

All orders will be delivered to the address you specified when you placed your order.

Orders will only be dispatched after confirmation of stock availability and confirmation that payment has been made. They will be dispatched by AMAZE's partner companies, who will arrange delivery of your order.

AMAZE offers the following shipping methods:

4.1 Portugal 

(Mainland Portugal, Azores and Madeira)

Up to 500g - €5.50 (3-5 working days*)
Up to 2kg - €8.50 (3-5 working days*)
From 2kg onwards, packages of 2kg are added for €8.50 each.

* Estimated delivery time may vary. AMAZE cannot be held responsible for failure to comply with estimated delivery times.

4.2 International

Europa

Up to 500g - 10,50€ (7-15 working days*)
Up to 2kg - 21,50€ (7-15 working days*)
From 2kg onwards, packages of 2kg are added for 21,50€ each.

Rest of the world

Up to 500g - 17,50€ (7-15 working days*)
Up to 2kg - 38,50€ (7-15 working days*)
From 2kg onwards, packages of 2kg are added for €38.50 each.

* Estimated delivery time may vary. AMAZE cannot be held responsible for failure to comply with estimated delivery times.

4.3 Impossibility of delivery

If it is impossible to deliver your order due to a fact not attributable to AMAZE or the carrier, you will be given a notice to collect the order from one of the CTT branches or you will be contacted at the email address or telephone number provided to reschedule delivery of the order.

5 - Exchanges and returns

5.1 General conditions
If, for any reason, you wish to exchange a product, you may do so freely within 14 (fourteen) days from the day after AMAZE delivers the order to you directly or to a third party indicated by you, other than the carrier.

Shipping costs are borne by the customer.

When exchanging the product, you must keep and present the purchase invoice and you must keep the product in such a way as to be able to return it in the proper conditions of use, still bearing the label, not exceeding the handling usually permitted in a commercial establishment, intact and in its original packaging.

5.2 Defective articles

AMAZE does not accept returns, except as provided for in this Section 5.3.

AMAZE guarantees the conformity of goods purchased on the website in accordance with the provisions of Decree-Law no. 67/2003, of 8 April, as amended by Decree-Law no. 84/2021, of 18 October.

To this end, it is necessary that the non-conformity of the product purchased manifests itself within a maximum period of 2 (two) years from the delivery of the product (‘Warranty’), within which there is a presumption that the non-conformity of the product existed on the date of delivery. After the said 2 (two) years have elapsed, it is up to the customer to prove that the lack of conformity existed on the date of delivery of the goods.

If, after examining the product, AMAZE finds that there is indeed a defect or lack of conformity of the product purchased, the customer may choose to request that the good be replaced free of charge, by repairing or replacing it, by reducing the price appropriately or by cancelling the contract with a full refund of the price.

Deadlines:

Repair of the product within a maximum of 30 (thirty) days.

Total or partial refund of the product in accordance with the conditions set out in Section 5.3.

Defects or malfunctions resulting from:
(i) improper use of the products;
(ii) failure to comply with the product instructions;
(iii) repairs carried out by unauthorised third parties.

Also excluded from the scope of the guarantee are the products that AMAZE sells, especially handmade, because they often have the characteristics of the natural materials used in their manufacture, which should not be considered a defect. These characteristics, such as variations in grain, texture, knots and colours, accuracy of weight, size or density, are not considered defects or lack of conformity. On the contrary, you should expect them to be present. Such characteristics are unavoidable and must be accepted as part of the product's individual appearance.

5.3 Refunds

AMAZE shall reimburse the amount relating to the returned product, without undue delay, and within a maximum period of 14 (fourteen) days from the date on which AMAZE was informed of its decision to terminate the contract, without prejudice to AMAZE's right to withhold reimbursement until it has received the returned goods, or until it provides proof of their return, whichever occurs first.

AMAZE makes refunds using the same means of payment used in the initial transaction, but may, at its discretion, opt for refunds through the allocation of gift vouchers.

If payment has been made by ATM reference, the refund will be made by bank transfer to the IBAN indicated by you.

AMAZE may cancel any order or not accept a confirmed order in the event of a technical error and/or an error in the prices or any information on the products on the website when the order is placed. AMAZE will reimburse the amounts paid in full.

6 - Prices

The prices paid for the products you order are those displayed on this website at the time the order is placed, including VAT at the legal rate of the AMAZE headquarters in force, but excluding shipping costs which will be added to the value of the order placed.

Prices are shown in Euros. If the order is paid for using a card whose currency is not Euro, the equivalent exchange rate will be applied at the rates in force according to the bank of the card in question. The fees associated with the exchange and/or processing of the international payment will be borne by the customer.

Shipping costs will be charged according to the amounts indicated on the website, calculated in particular according to the shipping method selected.

You will always be informed, in a clear and concise manner, before finalising the order, of the total price of the product, which includes the price, all duties and taxes, additional transport charges, shipping costs or any other costs that may exist.

AMAZE reserves the right to change the prices of products and shipping costs at any time, but this will not affect orders for which the order has already been finalised.

7 - Stock availability

All product orders are subject to availability. In this sense, if there is any difficulty in supplying products or if there are no products in stock, AMAZE will inform you of the unavailability and reimburse you the amount you may have paid, within a maximum of 30 (thirty) days.

8 - Communication

Applicable legislation requires that information or notifications sent be in writing. By using this website, you accept that notifications sent by AMAZE will be sent electronically.

For contractual purposes, you agree to use this means of electronic communication and recognise that all contracts, notices, information and other notices sent electronically satisfy the legal requirement that such notices be in writing. This condition shall not affect the rights recognised by law.

9 - Force Majeure

AMAZE will make every reasonable effort to fulfil its obligations.

However, it cannot be held liable for any failure to fulfil or delay in fulfilling any of the obligations it has undertaken, the cause of which is due to events beyond its control (‘Force Majeure’).

Force Majeure shall mean any unforeseeable and/or irresistible fact, act, event, failure, omission or accident or any other outside our control, including, but not limited to, the following:

  • General strike or other forms of protest;
  • State of siege or emergency, disturbance of public order, revolt, invasion, terrorist attack or terrorist threat, war (declared or not) or threat or preparation for war;
  • Fire, explosion, storm, flood, earthquake, landslide, epidemic, pandemic and sanitary fences, or any other natural disaster;
  • Inability to use trains, boats, aircraft, motor transport or other means of public or private transport;
  • Inability to use public or private telecommunications systems;
  • Decisions, decrees, laws, regulations or other normative instruments or decisions of any government or public authority.

AMAZE's obligations arising from the contracts shall be deemed to be suspended during the period in which the Force Majeure Events occur, AMAZE benefiting from an extension of the deadline for the fulfilment of such obligations, for a period of time equal to the duration of the Force Majeure Events.

AMAZE shall use all reasonable means to put an end to the reasons for Force Majeure or to find a solution that allows it to fulfil its obligations under the contract, despite the reasons for Force Majeure.

10 - Legal context

10.1 Property

All copyright, trademark and other intellectual property rights in the materials or content provided as part of the website are, at all times, the property of AMAZE or the licensor, and you may only use such material in the manner expressly authorised.

This does not prevent you from using the website to copy information relating to your order or contract details as necessary.

10.2 Applicable law

All questions relating to the application or interpretation of these Terms & Conditions, as well as any dispute arising from the interpretation, validity or breach of the contract entered into between the parties, shall be subject to the competent Portuguese courts.

Portuguese law shall apply to such disputes, expressly waiving any other law.

10.3 Dispute resolution

In the event that you are dissatisfied with the purchase of the product or the service provided on the AMAZE website, you may also, without prejudice to the right to submit the dispute to the judgement and decision of a court of law, resort to one of the Alternative Consumer Dispute Resolution Entities listed on the consumer portal, on the website www.consumidor.pt , or Online Consumer Dispute Resolution identified on the website https://webgate.ec.europa.eu/odr.

The customer may save, print or display the contents of this website for personal use only.

It is not permitted to publish, manipulate, distribute or reproduce, in any format, any content on this site, nor to link it to any business or company.

10.5 Commitment

Amaze reaffirms its commitment to protecting the data of its customers and visitors to this website. Therefore, and in compliance with the provisions of the General Data Protection Regulation

(Regulation [EU] 2016/679 of the European Parliament and of the Council of 27 April 2016) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, AMAZE has revised the Terms and Conditions of Use of the online shop, as well as its Privacy Policy.
